2. ABSOLUTE FINANCIAL & INSURANCE DISCLAIMER (IMPORTANT)

2.1 NOT INSURANCE OR WAIVER: You explicitly understand and agree that detectdamage.ai is NOT an insurance policy, Collision Damage Waiver (CDW), Supplemental Liability Protection, excess reduction product, or financial guarantee.

2.2 NO FINANCIAL COVERAGE: detectdamage.ai does not cover, pay, reimburse, waive, or indemnify you for any damage charges, excess fees, security deposit withholdings, repairs, or administrative costs levied by car rental providers, leasing companies, or third parties.

2.3 RENTAL CONTRACT OBLIGATIONS: Using detectdamage.ai does not exempt or release you from fulfilling all contractual obligations under your car rental agreement, including reporting pre-existing vehicle damage directly to rental provider staff at pickup.

3. Pricing, Packages & Refund Policy

3.1 Package Terms: The standard consumer offer is £15.00 for a 2-scan package (Collection & Drop-off inspection reports), representing a promotional price off our standard retail price of £30.00.

3.2 Scan Expiration: Purchased scan packages remain valid for thirty (30) days from the purchase date, after which unused scans expire without refund unless required by applicable law.

3.3 Refunds: Due to the instant digital generation of cryptographic time-stamped reports, sales are final once an inspection report process has been initiated. If a technical system error on our platform prevents report generation, your sole remedy is a replacement credit or a full refund of the £15.00 purchase price.

4. User Content & AI Model Training

4.1 You retain ownership of images and media you upload ("User Content"). By uploading content, you grant Detect Damage AI Ltd a non-exclusive, royalty-free, worldwide license to store, process, and analyze the content to generate your Inspection Reports.

4.2 You grant us permission to use anonymized, aggregated visual media to train, refine, and improve our AI damage-detection algorithms.

5. Intellectual Property

All software, algorithms, brand assets, and content on the Site and App (excluding your User Content) are owned by or licensed to Detect Damage AI Ltd and protected by UK and international copyright and intellectual property laws.

6. Limitation of Liability

6.1 No Guarantee of Dispute Outcome: While detectdamage.ai utilizes cryptographic verification to record visual vehicle states, we do not guarantee that third-party rental companies, credit card issuers, arbitrators, or courts will rule in your favor during a damage dispute.

6.2 Liability Cap: To the maximum extent permitted by applicable law, Detect Damage AI Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages (including lost rental deposits or third-party repair bills). Our total cumulative liability arising from your use of the service shall not exceed the amount paid by you for the specific package purchased (i.e., £15.00).

7. Termination & Account Suspension

We reserve the right to suspend or terminate your account or access to our services immediately, without prior notice, if we suspect any violation of these Terms, fraudulent activity, or misuse of our platform.

8. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oxford, England.
